By using this website, you represent that you have the legal authority to accept these Terms of Service. If you are accessing this site on behalf of a corporation, you represent that you have the authority to bind that entity to these terms.
2. Nature of Services
Elite Surf Foundation provides surf therapy programs and coastal restoration projects. Our digital platforms provide information, ESG calculators, and reporting tools. While we strive for absolute accuracy, all "Impact Estimates" and "Carbon Calculators" are intended for planning purposes and do not constitute a legal guarantee of specific ecological outcomes until officially audited.
3. Intellectual Property
All content on this site, including the "Elite Surf Foundation" name, logo, custom calculators, training methodologies, and media assets, are the exclusive property of Elite Surf Foundation.
- Partners and sponsors are granted a limited, non-exclusive license to use our logo for their internal and external CSR reporting.
- Unauthorized reproduction of our 3-year stewardship pathway or proprietary surf therapy protocols is strictly prohibited.
4. Donation & Sponsorship Terms
All financial contributions are processed as charitable donations to our 501(c)(3) entity.
- Non-Refundability: Due to the immediate allocation of funds to active coastal restoration and youth cohort logistics, all sponsorships and donations are non-refundable.
- Tax Documentation: We will provide an official receipt for tax purposes within 30 days of the contribution. It is the donor's responsibility to consult with their tax professional regarding specific deductions.
- Tier Benefits: Elite Surf Foundation reserves the right to adjust specific "Tier Perks" (such as naming rights or retreat details) based on local environmental conditions or operational safety.
5. Blue Carbon & ESG Reporting
When you sponsor a "Blue Carbon" track, we commit to the planting and maintenance of the specified mangroves. However, carbon sequestration metrics are based on scientific models and local growth rates.
- Annual survival audits are conducted by third-party ecological partners.
- Elite Surf Foundation is not liable for "Acts of God" (e.g., extreme weather events) that may impact the survival rate of restored territories, though we commit to replanting efforts as part of our core mission.
6. Partner Portal Conduct
Access to the Partner Portal is a privilege. You agree to maintain the confidentiality of your login credentials and to use the portal only for viewing impact reports and managing your organization's sponsorship.
7. Limitation of Liability
In no event shall Elite Surf Foundation, its directors, or its employees be liable for any indirect, incidental, or consequential damages arising out of your use of our website or participation in our programs. Our total liability for any claim shall not exceed the amount of your most recent annual contribution.
8. Governing Law
These terms are governed by and construed in accordance with the laws of the United States (specifically relating to 501(c)(3) status) and the laws of the Republic of Costa Rica for all on-the-ground operational matters. Any disputes shall be resolved in the appropriate courts of Guanacaste, Costa Rica.
9. Modifications
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to this website. Your continued use of our services following the posting of changes constitutes your acceptance of such changes.
